Legal framework for prohibiting Dowry
For women's safety and security, government is taking a special check. In recent years against dowry special amendments are taking place. - 1. Section 4: Demanding dowry:
According to Dowry Prohibition Act, 1961, it is for those who demand dowry. While the judgment penalty is there for those who forced for dowry. It can be indirectly or directly, the punishment is equal for the one who torture others. In last few years, there were many cases which came in front; in this along with husband even relatives play a special role.
So, in case of physical harassment if parents are also involved then everyone will be punished equally. In this special security is offered by the government to the victim women. Imprisonment varies from 6 months to 2 years or more. So after the complaint of victim, the judgment is made by government. The punishment can be extended extend if in case of dowry death. Fine charged by government lies from ten thousand rupees to value of dowry.
- 2. Dowry Death, section 304 B:
A legal framework was specially designed, for security of women. In past few years, due to dowry system women have suffers a lot. Some of them have to compromise with their life. So section 304 B was established, in such cases if women die due to any bodily injury such as burns or overdose of drugs. Then imprisonment can be from 5 to 10 years. In this who so ever is involved is punished equally. It can be like imprisonment for life also.
- 3. Cognizance of offense:
As per the rule of section 7, a Judicial Magistrate of First Class or Metropolitan Magistrate can do judgment by listening the victim. Before any punishment, the court will equally hear both the parties equally and will check police report. During this parents and relatives will listen to both parties and will send women for a medical check. Thus in case of harassment, the punishment is made.
To stop this dowry system certain laws are made by the Indian government. Good thing is that even other women welfare organizations are there are always there to help victim women. They provide them food and shelter so that they can feel safe. Moreover to spread awareness among women about dowry prohibiting act various programs are assigned by welfare academies.
